The Pemrittee, Cooley Gravel Company desires to conduct a mining operation [mown as Dahlia <br />North Resources Pit, for the purpose of extracting sand and gravel. The Pemrittce will not mine any secondary <br />commodities at this site. <br />B. On March 28, 1995 the Mined Land Reclamation Board (the "Board") approved the Pemlittee's <br />application for this permit, fnced the amount of the furancial warranty and directed that this pemrit be issued upon <br />the filing with the Division of Minerals and Geology (the "Division's of perfomrance warranty and financial <br />warranty (or warrarrties) in the amount so fixed in forrrr and substance approved by the Division. Said warrarrties <br />have been filed with the Division. <br />C. If the Pemiittee desires to extras materials other than those listed m (A), a separate pemrit may <br />be required. • <br />D. On March 28, 1995 the Boats made the following findnlgs: <br />1. The application for this permit complies with the requirements of the Colorado Mined <br />Land Reclamatirm Ad for the Extraction of Construction Materials, C.R.S. 34-32.5-101 ~ ~., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any significant, valuable, and <br />permanent man-made stmcture located within two hundred feet of the Affected Land, exczpt where there is an <br />agreement betweerr the Operator and the persons having an interest in the structure that damage to the stnrcture is <br />to be compensated for by the Permittee; and; <br />
