Whole Effluent Toxicity-Chronic Lethality Limitation -Outfalls 003. 022 and 024 <br />Beginning Aoril 1 1997, and lasting through March 31, 1999, there shall be no statistically significant difference in <br />lethality (at the 95'Y conl~idence level) between the control and any efFluent concentration less than or equal [0 11.590 <br />effluent. Such limitation shall apply as a daily maximum. <br />3. Burden of Proof Requirements <br />The permittze has the burden of proof when seeking relief from settleable solids (SS) limitations. C~ischarges from <br />outfalls 004, 007, 009, OI I - 021 are eligible for this exemption. <br />Relief may be granted for each discharge occurrence only when necessary and shall not be granted when the permiitee <br />has control ovzr the discharge. The permittee should endeavor to meet the primary limitations whenever possible. <br />a) For rainfall, to waivt: settleable solids limitations, it is necessary to prove that discharge occurred within 48 hours <br />after precipitation greater than the (0-year, 24-hour event has stopped. <br />h) For snowmelt. to waive seuleablz solids limitations, it is necessary to prove that discharge occurred within 43 hours <br />after pond inflow volume greater than the 10-year, 24-hour event has stopped. <br />Should a precipitation event or snowmelt occur, the perminee shall submit adequate proof in order fir an exemptton to <br />bz claimed. Weather station data may be appropriate in making this demonstration. Said proof shall be submitted as an <br />attachment to the Discharge Monitoring Report (DMR) for the appropriate period. The Division shat{ determine the <br />adequacy of proof. As p.ut of this determination, the Division shall evaluate whether the permillee could have <br />controlled the discharge i~a such a manner that primary limitations could have been met. All manual dzwatering of the <br />ponds shall meet settleable solids limitations. <br />4. Salinity Parameters <br />In order to obtain an indication of the quantity of Salinity being discharged from the site, the permil!ee shall monitor the <br />wastewater efFluent for total dissolved solids at the following frequencies: <br />Outfall Frequency Sample Tvoe <br />003, 004, 007, 009, 011, 012, O13, 014, OIS, Quarterly Grab <br />016, 017, 018, OI9, 020, 021, 022, 023 and 024. <br />Self-monitoring samples taken in compliance with [he monitoring requires specified above shall be taken a[ those <br />locations listed in Part i.Et.l. <br />Amendment No. I Issued Effective <br />See Parl LC. for Delinitinns. <br />
