The Colorado <br />Division of Minerals and Geology submitted adequacy review comments to the applicant on <br />October 1, 2004. The information and discussion below addresses each comment as it was <br />presented by the Division.. <br />1. Exhibit A -Legal Description <br />The property is located in portions of Sections 25 and 36, Township 1 North, Range 67 West and <br />Section 30, Township I North, Range 66 West of the Sixth Principle Meridian, Weld County, <br />Colorado. The corrected legal description is attached. <br />2. Exhibit D -Mining Plan and Exhibit S -Permanent Manmade Structures <br />a) Bore log data collected in November 1997 indicate that bedrock is, in a few areas, about <br />41 feet below the surface of the proposed Wattenberg Lakes site. However, these areas are <br />not near the permit boundary where 40-foot or 25-foot setbacks are proposed. The areas <br />where bedrock is located 40 feet below the surface are located in the north-central and <br />northeastern portion of the site where mining setbacks will be at ]east. 100 feet from the <br />proposed permit boundary. <br />b) The majority of on-site permanent manmade structures owned by the ,City of Westminster <br />will be removed prior to mining. However, prior to mining within 200 feet of structures left <br />in place, Aggregate Industries will provide the Division with a notarized agreement between <br />the applicant and the City of Westminster. _ <br />c) Protection measures will be taken for the safe storage and transfer of fuels and lubricants at <br />the site. Depending on production and reclamation phasing and scheduling, mobile (i.e. <br />tanker trucks) and/or portable (i.e: stationary tanks) storage facilities may be used for fueling <br />and lubricating mining equipment. While mobile sources are in use, a designated area will <br />be established to perform fueling and lubricating operations. When not in use, the mobile <br />sources would be removed from the site. It may also be necessary to use portable facilities <br />for storing fuels and ]ubricants at the site.
