Dear Mr. Squire:
The following discussion and attachments are submitted on behalf of our client in response to the
adequacy review comments received for the proposed Wattenberg Lakes project. The Colorado
Division of Minerals and Geology submitted adequacy review comments to the applicant on
October 1, 2004. The information and discussion below addresses each comment as it was
presented by the Division..
1. Exhibit A -Legal Description
The property is located in portions of Sections 25 and 36, Township 1 North, Range 67 West and
Section 30, Township I North, Range 66 West of the Sixth Principle Meridian, Weld County,
Colorado. The corrected legal description is attached.
2. Exhibit D -Mining Plan and Exhibit S -Permanent Manmade Structures
a) Bore log data collected in November 1997 indicate that bedrock is, in a few areas, about
41 feet below the surface of the proposed Wattenberg Lakes site. However, these areas are
not near the permit boundary where 40-foot or 25-foot setbacks are proposed. The areas
where bedrock is located 40 feet below the surface are located in the north-central and
northeastern portion of the site where mining setbacks will be at ]east. 100 feet from the
proposed permit boundary.
b) The majority of on-site permanent manmade structures owned by the ,City of Westminster
will be removed prior to mining. However, prior to mining within 200 feet of structures left
in place, Aggregate Industries will provide the Division with a notarized agreement between
the applicant and the City of Westminster. _
c) Protection measures will be taken for the safe storage and transfer of fuels and lubricants at
the site. Depending on production and reclamation phasing and scheduling, mobile (i.e.
tanker trucks) and/or portable (i.e: stationary tanks) storage facilities may be used for fueling
and lubricating mining equipment. While mobile sources are in use, a designated area will
be established to perform fueling and lubricating operations. When not in use, the mobile
sources would be removed from the site. It may also be necessary to use portable facilities
for storing fuels and ]ubricants at the site. The on-site storage of fuels and lubricants will
