;~ <br />III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. The permit has been revoked and the Mine <br />reclaimed so no company representative was present. Weather was mild and dry at the time of the inspection. The <br />region had been experiencing unseasonal rainfall amounts the preceding two weeks (Approx. 8" over a 5 day period in <br />mid September at a Mine several miles to the South.) No cattle or sheep were present on the site. The inspection was in <br />between hunting seasons. Planned maintenance work to be performed by DMG contractors has been delayed due to <br />weather delays at other contracted work sites. IML coordinator projects site work will commence in early November. This <br />prospective schedule also avoids potential conflicts with hunting parties as requested by the landowner, Cross Mountain <br />Ranch. <br />The inspector attempted to inspect recods at the Terramatrix offices in Steamboat Springs. Records had been moved to <br />the warehouse located away from the offices. The inspector continued on to the Mine site with arrangements to return to <br />inspect the records upon finishing at the Mine. Workers for the neighboring Mine, YoasT Mine, locked the access gate, <br />trapping the inspector on the Mine site. Inspector was unable to check records at Terramatrix office due to the delay of <br />leaving the Mine site. Records will be checked mid-October. <br />Mine signs and permff markers are no longer in place. <br />DMG plans ro perform maintenance on several of the roads as detailed in the bid request package. The portion of the <br />access road needing additional roadbase is 1 mile south of the access gate and extends approx. 0.1 mile. Road cuts still <br />exhibit evidence of thistles. Thistles are dying back this time of year. No evidence of Whitetop could be noted at this <br />time of year. Road ro Pit 1 has ruts 1 foot deep. The upper portions of pit 1 access road are fairly well vegetated and pit <br />1 does not necessitate vehicular access. Tfie Division does not plan to grade these ruts out during this Fall's <br />maintenance work. This road is easily traversed by foot. Access road to Pit 6 has some downcutting occurring. Minor <br />blading of this access road would redirect surface runoff into the ditches. Access road to Pits 2/3 continues to downcut <br />as a consequence of water flow from springs emerging from the native hillslopes. Grading and placement of waterbars to <br />redirect flows are planned for maintenance projecT this fall. Springs continue to flow. Access road to Pit 4 is rutted on <br />lower portion just prior to curve to South. This location is slated for grading during maintenance work. Springs alongside <br />pit 4 access road have dried up for the season. Road ditch North of Oil Well site will be shaped during maintenance <br />operation ro keep drainage off roadway. Ditch 5.3 continues to downcut. This is slated for maintenance this fall. Rip- <br />rapped ditch 5-4 is side cutting. Grading of this portion of the ditch just East of intersection with ditch 5-3 should <br />occur during maintenance this Fall. <br />Wildlife- No Elk or deer observed on site. One fawn or elk calf carcass was encountered along access road near Pit 5. <br />Grogs were heard ar puddles area at Pit 6. Numerous songbirds, ground squirrels, and chipmunks were noted throughout <br />the Mine site. <br />Vegetation throughout the reclaimed pit sites looks good. Thistle is present in sporadic areas throughout the pit areas. <br />Pit 1 is predominantly Big bluegrass, various wheatgrasses, fescues. present to lesser degree are Yarrow and Timothy. <br />Sagebrush is invading along edges. <br />
