At the Pre-hearing Conference, lists of possible witnesses and exhibits for the <br />Final Hearing were submitted by CAIv1A5 Colorado, Inc., and Mike Jeronimus. The lists were <br />attached to the pre-hearing order. <br />8. The pre-hearing order was mailed to [he parties on July 20, 1999. <br />9. The Board held the Final Hearing in this matter on July 27, 1999, in Denver, <br />Colorado. The Division attended as staff to the Board. <br />10. At the Final Hearing, the Board's attorney presented the pre-hearing order to the <br />Board on behalf of Ms. Brown, who was unable to attend the hearing. After considering the pre- <br />hearing order, the Board adopted the pre-hearing order as submitted. <br />11. The only objector party to the matter present at the final hearing was Miriam J. <br />Bromley, who had concerns related to the issue of possible impacts to the quantity of ground and <br />surface water. Ms. Bromley presented to the Board an indemnification agreement she had <br />entered into with CAMAS regarding protection of the water levels in certain ponds on her <br />property. Ms. Bromley requested that the agreement be incorporated into the Board's decision, <br />but the Board denied her request in favor of adding Condition No. 2 of the Order below. <br />12. In consideration of the presentations made at the hearing, the Board finds that: <br />A. CAMAS has full legal right of entry to the site. As Jeronimus and <br />Gardner, the proponents of the legal right of entry issue, were not present at the hearing <br />to further explain their issue, the Board finds that the issue has been adequately addressed <br />as it is presented in the Division's recommendation rationale. <br />B. Subject to Condition Nos. 1 and 2 of the Order below, the M-99-034 <br />permit application and reclamation plan adequately addresses possible impacts to <br />quantity and quality of surface and groundwater. <br />ORDER <br />Based on the above findings of fact and conclusions of law, the Board hereby APPROVES <br />CAMAS' l 12 permit application, subject to the following conditions: <br />CONDITION NO. 1 <br />Engineering designs, specifications, a constmction timetable, and a quality assurance plan for the <br />slurry wall will be incorporated into the permit via a technical revision prior to commencement <br />
