M-95-075, RECEIPT OF 112 CONSTRUCTION MATERIALS <br />RECLAMATION PERMIT APPLICATION PACKAGE -INADEQUATE <br />Dear Mr. Archuleta: <br />On December 14, 1995, the Division of Minerals and Geology received your application package <br />fora 112 Construction Materials Reclamation Permit for the Coleman Pit, File No. M-95-075. <br />Due to Mineral Rules and Regulations and the Colorado Reclamation Act for the Extraction of <br />Construction Materials, Senate Bill 95-156, which became effective July 1, 1995, preliminary <br />review of the information received determined that the following information must be received <br />before the Division can consider your application submitted and can begin the technical review: <br />1) The completed application form is outdated. Please fmd for your use one of each type <br />application form. Copy as necessary, execute and re-submit the Regular 112 application <br />form. <br />Failure to submit the items above by the initial decision date of March 14, 1996, will result in <br />a decision to deny your application. You may amend your application by submitting the <br />requested items. In accordance with Rule 1.4.5 a new decision date will be established 90 days <br />from ttre date of receipt of all requested items. If you have already initiated publication, you <br />will need to republish notice which specifies a 45 day public comment period from the new date <br />of newspaper publication. <br />This letter shall not be construed to mean that them are no other technical deficiencies in your <br />application. After the submittal of all required items, the Division will review your application <br />to determine whether it is adequate to meet the requirements of the Act. <br />Please contact me if you have any questions regarding this matter. <br />Sincerely, <br />Lavern P.
