Box 299 <br />Silverton, Colorado 81433 <br />Dear Mr. Feams, <br />Permit: CO-0027529 <br />San Juan County <br />The Water Quality Division has received your request for a compliance schedule with respect to the <br />certification status of the operator in responsible charge for the industrial wastewater system associated <br />with the Gold King Mines - American Tunnel Facility. You have indicated to us that you will test for the <br />"C" level industrial wastewater treatment certification during the spring 2004 examination cycle. During <br />the interim, your activifies at the facility will be under the supervision of Mr. Larry Perino, a certified <br />level "C" industrial wastewater treatment facility operator. <br />The Gold King Mines American Tunnel Facility will be required to have an operator in responsible <br />charge, fully certified at the appropriate level, by June 30, 2004. Until that time, the Division recognizes <br />that the system is in the process of becoming compliant with the applicable law and regulations governing <br />water and wastewater facility operators' certification in Colorado and will, absent monitoring or treatment <br />technique violations, exercise its enforcement discretion. <br />Keep this interim compliance statement on file. It must be available whenever your facility is <br />inspected, otherwise the facility maybe cited For a violation of section i5-9-110(2a) Colorado <br />Revised Statutes, 2000. t <br />Please use the enclosed form to notify the Division immediately when you are certified at the appropriate <br />level so that we may amend your files to indicate full compliance.
