DISCUSSIGM: <br />Applicable effluent limitations and monitoring requirements regarding active <br />mining outfalls are addressed in Part I.B.1(a) and I.B.3(a) respectively of <br />the general permit. The effluent limitations and monitoring requirements <br />regarding any applicable postmining activities are addressed in Part I.B.1(b) <br />and I.B.3(b) respectively of the general permit. At this time, based upon a <br />review of the facility conditions, discharge point 001 is still subject to <br />active mining limitations and monitoring requirements. Monitoring of the <br />discharge for Total Dissolved Solids and Total Phosphorus is not required for <br />this permit. See page 3 of the general permit for more information. <br />The Permittee will be required to develop and implement a Storm Water <br />Management Plan (SWMP). Although some activities may already be in place, the <br />SWMP will require the Permittee to coordinate best management practices so the <br />result is a reduction or elimination of pollutants reaching state water from <br />areas not limited by effluent limitations. The Permittee will be required to <br />submit the SWMP to the Division for review within six months from the dace <br />certification is issued. For specifics of the Plan and additional <br />requirements, please reference the Part I.B.2 of the general permit. <br />There are neither any landfills nor is there bulk storage of diesel fuel, <br />gasoline, or solvents located adjacent to or near this facility. There is a <br />refuse mine tailings storage area on site, as shown in figure 1 of the permit. <br />Additionally, there are no known drinking water intakes within 5 miles <br />downstream. <br />The permittee will not be required to perform Whole Effluent Toxicity (WET) <br />testing pursuant to Section 6.9.7(2)(a)(i)(A) of the Regulations for the State <br />Discharge Permit System 6.1.0 (5 ccr 1002-2) which exempts facilities <br />certified under the general permit. <br />The Permittee is encouraged to read the general rationale for an understanding <br />of how the general. permit was developed and to read the permit itself to see <br />what requirements exist. Effluent limitations and monitoring requirements are <br />specified in Part I.B, and special notification requirements for effluent <br />violations are addressed in Part II.A.3. <br />It should be noted that as of October 1, 1992, the Health Department is moving <br />to a new location, and thus the mailing address has now been changed. Instead <br />of the address indicated on page 13 of the permit, discharge monitoring <br />reports should be sent to the WQGD at the following address: <br />Colorado Department of Health <br />Water Quality Control Division <br />WQCD-PE-B2 <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80222-1530 <br />Based on the above information, Energy Fuels Mining Company is certified to <br />discharge from the Raton Creek Mine under the general permit for coal mining <br />facilities, identified as Permit No. COG-850000.
