_ • <br />No assignment or transfer of this lease will be held valid by Lessor <br />unless made with its consent in writing and duly entered in the books or records <br />of said Board. <br />10. Bonds and surface damage--Lessee shall be liable and agrees to pay for <br />all damages to the surface of the land, li•estock, growing crops or improvements <br />caused by Lessee's operations on said lands. It is agreed and understood [hat no <br />operations shall be commenced on the lands hereinabove described unless and until <br />the Lessee or his assignee shall have filed a good and sufficient bond with the <br />Lessor in an amount to be fixed by Lessor, to secure the payment for such damage <br />to the surface of the land, livestock, growing crops or improvements as may be <br />caused by Lessee or his assignee's operations on said lands. With Board approval <br />the bond may be waived in favor of that which may be required by the Colorado <br />Division of Mined Land Reclamation. <br />Lessee Further agrees to slope the sides of all surface pits or <br />excavations to a ratio of not more than one foot (1') vertical for each two feet <br />(2') horizontal distance. Such sloping shall become a normal part of the <br />• operation of the lease so as to keep pace with such operation to the extent that <br />such operation shall not at any time constitute a hazard. Wherever practicable, <br />all pits or excavations shall be shaped to drain and in no case shall the pits or <br />excavations be allowed to become a hazard to persons or livestock. All material <br />mined and not removed from the premises shall be used to fill all pits and pits <br />leveled unless consent of the Lessor to do otherwise is .obtained, so that at the <br />expiration, surrender, or termination of the lease the land will as nearly as <br />practicable approximate its original configuration, with a minimum of permanent <br />damage to the surface. <br />11. Reclamation--Rules and regulations as set forth by the Colorado Division <br />of Mined Land Reclamation for recovery and restoration of mined land will apply <br />where applicable to the lands leased herewith. Variations may be granted only <br />with approval of Lessor. <br />12. Inspection--It is agreed that during all proper hours and at all times <br />during the continuance of this lease the Lessor, or its duly authorized agent, <br />shall be, and hereby is authorized to go through any of the openings or workings <br />on said premises, and to examine, inspect and survey the same and to examine and <br />make extracts or copies of all books and sheets which show in any way the output <br />of the Leased premises, and that all conveniences necessary for said inspection, <br />survev or examination shall be furnished to the Lessor, or its agent, by the <br />Lessee. <br />• l3. Exploration Data-- It is agreed that the Lessee, while using any drill on <br />said premises during the term of this lease, shall keep an accurate log of all <br />work so done and performed, showing the formations penetrated, the depth or <br />thickness of each, the character of each, their elevations, the location of same <br />by tying to a comer of some legal subdivision or, in unsurveyed territory, [o <br />some bench mark or other officially established point, established by the United <br />States surveys, and each and every thing necessary to make and supply a perfect <br />and complete Iog of [he hole throughout its entire depth, a true copy of which <br />said loq_ shall be furnished the Lessor when and at the time such holes are <br />drilled or at any time [hereafter upon demand of the Lessor. <br />14. Maps-'A map of the workings herein authorized shall he made yearly by an <br />engineer or surveyor duly licensed by the State of Colorado, on a scale of not <br />less than 100 feet to the inch, showing the vertical and horizontal dimensions of <br />all excavations, fills, stockpiles, and other disturbances of the surface, by <br />means of accurate contour lines (not more than two-foot interval) or <br />cross-sections, all to be correctly related to a base line which is properly <br />located in relation to known section lines in the area; said map to show county, <br />section, township, and range, the name of the company or operator, the North <br />point, the scale to which the map is drawn and explanatory legend, and the <br />certificate of the engineer or surveyor as to its accuracy. The engineer or <br />surveyor shall show clearly upon said map the cubic yards of material displaced <br />and removed by the operation since the previous survey, map, and report. <br />Maps and plans he reinbeEore mentioned shall be extended and corrected at <br />least once each year. True copies of all maps and plans shall he provided as <br />• follows: The original maps and tracings to be kept in the office of the engineer <br />ar surveyor, blue or white prints certified to by engineer to be on file a[ the <br />office of the State Board of Land Commissioners, Denver, Colorado. <br />-3- <br />
