THIS LEASE, Made in duplicate and entered into on this 29th day <br />of April 19 85, by and between the STATE OF COLORADO, acting through <br />its State Board of Land Commissioners, hereinafter referred to as "Lessor", <br />and Board of Count Commissioners Fremont Count <br />P. Box 349, Canon Citv, Colorado 81212 <br />hereinafter referred to as Lessee: <br />W I T N E S S E T H <br />2. Lessor, for and in consideration of the sum of Fifty-t~a0 and 75/100 - - - <br />•~ - - - - - - - - - - - - - - - - - - - - - - Dollars receipt of <br />which is hereby acknowledged as payment of filing fee in the amount of <br />$ 12.75 and first year's rental in the amount of 5 40.00 and <br />in Eur[her considers[ion of [he Lessee's agreement to make payments of rental <br />annually on or before each anniversary date during the term of this lease in like <br />amount so long as said lease shall remain in effect. A penalty of ~ 25.00 <br />shall be charged for any rental payment received after the anniversary date of the <br />lease. In further consideration of the covenants and agreements hereinafter <br />mentioned, to be kept and performed by the Lessee, his successors and assigns, <br />Lessor has demised and leased to the Lessee the right and privilege of taking sand <br />and gravel and rock from the lands hereinafter <br />described, situate, lying and being in the County of Fremont , <br />and State of Colorado, to-wit: <br />DESCRIPTION OF LAND SECTION TOWNSHIP RANGF. <br />S/2NW/4SE/4; N/25W/4S E/4 36 16S 73W <br />• FUND: SCh001 PATENTS: None <br />containing 40.00 acres, more or less, together with the right to use as much <br />of the surface thereof as may reasonably be required in the exercise of the rights <br />and privileges herein granted, subject to existing rights-oE-way and the rights of <br />surface lessees of said premises. <br />3. Reserving, however, to the State of Colorado: <br />a. The right to use or lease said premises or any par[ thereof at any <br />time for any purpose other Chan and not inconsistent or interfering <br />with the rights and privileges herein specifically granted. <br />b. The right at all times during the life of this lease to go upon said <br />premises and every part thereof, for the purpose of inspecting same, <br />and the books of account and records of workings therein, and of <br />ascertaining whether or not said Lessee and those holding thereunder <br />by and from it, are carrying out the terms, covenants and agreements <br />in this lease contained. <br />c. The right to grant rights-of-way over said premises for pipelines, <br />roads, railroads, power, telegraph, telephone, ditches, and canal <br />lines, or lease the above-described lands for any other purpose than <br />the one specified herein, which such grants or leases shall be so made <br />as not to interfere with the operation of this lease, and so as to <br />require the grantees of such rights [o assume alt risk resulting <br />therefrom. <br />-1- <br />
