PERMIT NUMBER: COG-850000 <br />APPLICATION AND CERTIFICATION: <br />The owner, operator and/or authorized agent for a facility shall submit an <br />application ae provided by the Water Quality Control Division. Thi's application <br />will be evaluated utilizing the criteria outlined previously. If the general <br />permit is applicable to the applicant's operation, then a rationale will be <br />developed and the applicant will be certified under the general permit. The <br />rationale shall include the name and address of the contact person, a discussion <br />of compliance under any previous permit, if applicable, the receiving water for <br />the discharge, number of outfalls, a determination of the need for salinity <br />monitoring and a statement of whether active mining or poet-mining limitations <br />apply to each outfall. <br />If after evaluation of the application, it is found that the general permit is <br />not applicable to the operation, then the application will be processed as one <br />for an individual permit. Every applicant will be of the Division's decision. <br />For an individual permit, 180 days will be required to process the application <br />and issue the permit. In this case discharge cannot take place until the permit <br />is issued and becomes effective. <br />Addition or deletion of a sedimentation pond/outfall will require separate <br />application, which will be subject to the 30-day time frame also. <br />If after evaluation of the application for an existing source with a valid <br />permit, it is found that the general permit is not applicable to the operation, <br />then the applicant will continue operation under the existing individual permit. <br />If a facility operating under the general permit encounters mine drainage or <br />other source not covered by this general permit, it will be necessary to apply <br />for an individual permit. Coverage will continue under the general permit until <br />issuance of the individual permit. , <br />The general permit itself contains tl{e-effluent limitations and the monitoring <br />requirements for the authariz~ d outfalls. The following teat details the <br />rationale for the conditions of the general permit. <br />EFFLUENT LIMITATIONS: <br />Effluent limitations are based on State Effluent Standards (SES), State Water <br />Quality Standards (WQS), Federal Best Practicable Control Technology (BPT), and <br />Federal Best Available Technology Economically Achievable (BAT) or Federal New <br />Source Performance Standards (NSPS). Briefly, a new source is a facility or a <br />major alteration to a facility which was constructed after May 4, 1984. Tables <br />1 and 3 present a comparison of appropriate limitations (active mining/post- <br />mining respectively). Tables 2 and 4 show limitations selected as being the <br />most stringent of those. in Tables 1 and 3, with the exception of Total Suspended <br />Solids (TSS). The reason for the selected TSS limitation is explained after the <br />tables. Some of the limitations shown in Tables 2 and 4 may be exempted under <br />certain conditions upon submission by the permittee and approval by [he division <br />of specific proof.
