<br />B. EFPLUENT LIMITATIONS AND MONITORING REQUIREMF,NTS <br />1. Effluent Limitations <br /> <br />PART I <br />Page 6 <br />Permit No. COG-850000 <br />(c) General Limitations - Active and Poet-Mining <br />1. There shall be no discharge of sanitary waste waters from <br />toilets or related facilities. <br />2. There shall be no discharge of floating solids or visible foam <br />in other than trace amounts. <br />3. No chemicals are to be added to the discharge unless permission <br />for the use of a specific chemical is granted by the permit <br />issuing authority an_d imposition of such special conditions as <br />are appropriate. <br />4. Sulk storage structures or petroleum products and other <br />chemicals shall have adequate protection so as to contain all' <br />spills and prevent the material from entering discharged waters <br />or waters of the state. Additional requirements are set forth <br />in Section 311 of the Federal Clean Water Act. <br />5. There shall be no land application of wastewater, other than <br />far dust control. <br />(d) Burden of Proof Requirement <br />The permittee has the burden of proof when requesting relief from <br />total suspended solids (TSS), total iron and/or settleable solids <br />limitations. <br />For rainfall, to waive TSS and total iron limitations, it is <br />necessary to prove that discharge occurred within 48 hours after <br />measurable precipitation has stopped. In addition, to waive <br />settleable solids limitations, it is necessary to prove that <br />discharge occurred within-48 hours after precipitation greater than <br />the 10-year, 24rhour event has stopped. <br />For snowmelt, to waive TSS and total iron limitations, it is <br />necessary to prove that discharge occurred within 48 hours after <br />pond Snflow has stopped. In addition, to waive settleable solids <br />limitations, it is necessary to prove that discharge occurred <br />within 48 hours after pond -inflow volume greater than the 10-year, <br />24-hour event has stopped. <br />The division shall determine the adequacy of proof. <br />(e) Poat-Mining Areas <br />A post-mining area is defined as an area in which active mining has <br />ceased, all surface areas have been returned to the required <br />contour and revegetation has begun. When the area serving an <br />outfall meets these requirements the permittee shall notify the <br />division so that appropriate modifications can be made. Each <br />facility certification shall state whether active or poet-wining <br />limitations apply to each authorized outfall. <br />
