The general permit which provides coverage for these facilities is due to expire on June 30, 1992. <br />We have not yet received a renewal application for the facilities listed above. Should a discharge occur after <br />expiration of the permit, it will be in violation of the Water Quality Control Act aad the federal Clean Water Act. <br />Such a violation may result in enforcement action by the Water Quality Control Division. <br />Enclosed is a renewal application for coverage under the general permit. If it is resumed to the Division by June <br />30, 1992 there will be no lapse of coverage. It should be noted that EPA finalized the Stormwater Regulation on <br />November 16, 1990. This regulation requires coal mines to be covered by a permit which addressed stormwater <br />discharges until bond release. The Division has modified the general permit to accomplish such coverage. <br />Therefore, by reapplying for coverage under the general coal mining permit, you also comply with the requirements <br />of 40 CFR PaR 122.26. <br />We anticipate receipt of your renewal application in the near future.
