<br /> <br />Response to Randall Shepard <br />Delta Paving Gravel Pit <br />File No. M-98-105 <br />Page 3 <br />Your concerns regarding the weak land use and zoning laws in Delta County do not appear <br />to be a jurisdictions{ issue for DMG. Any operator of an approved construction materials <br />permit may modify the post mining land use, as provided by the Act and Rules. However, <br />significant modifications to the approved post mining land use may require public <br />notifications and publications, with associated public comment periods, similar to those <br />required for a new application. <br />Also the possib/e f/ooding of site 2 and maybe sites 4 & 7 if the Netiona/ Park Service carries <br />out if plan. As of now /don't know if this would be a yearly thing or just a one shot flood. <br />Even in the permit it to/ks about how in high wafer years one of the sites near the river might <br />be affected. <br />DMG has identified potential flooding of the proposed affected areas as a permitting issue <br />and has requested that the applicant provide additional information, clarifying how the <br />proposed operation will protect against pollution of surface and groundwater resulting from <br />high flows on the Gunnison River. <br />Judging by the feedback l have goften from people /have to/k to about this, there seems to <br />be very lift/e support far this type of operation here... /ask that this project not be approved, <br />or if it is that fhe 3 sites near the river be withdraw and not mined. <br />The Act and Rules provide opportunity for public participation throughout the permitting <br />process. The Board and DMG will consider all comments, submitted in accordance with <br />the Act and Rules, in its review process and final permit consideration. However, the Act <br />and Rules state that the Board or DMG shall not deny a permit application which satisfies <br />the minimum requirements of the Act and which is not contrary to local, state, and federal <br />laws or regulations. <br />Thank you for your comments.
