The applicant commits to submitting a technical revision to the permit with detailed information on <br />construction of the compacted clay liner. The applicant also commits to submit a quality control <br />and assurance plan for the Division's review and approval. <br />d. The applicant commits to submitting construction reports to the Division for clay-lined slopes that <br />have been completed. <br />14. Thank you. <br />15. The conveyors are portable structures. We reviewed numerous 112 permits that the Division has <br />approved within the last few years. The Division did not require any of the operators whose <br />applications that we reviewed to include the cost of conveyors, batch plants, office trailers, or any other <br />portable equipment. Based on our enclosed cost estimate, we do not believe any additional information <br />is required to be submitted regarding the conveyor structure. As previously explained in our March 23b <br />letter, the conveyors and crossing structures will be assets owned by the operator. If the operator was <br />to cease operations and the Division was forced to reclaim the site, the operator would remove the <br />conveyors. Even if the operator did not take the conveyor, it would have a market value that would <br />more than offset the cost to remove it. However, the concrete foundations for the conveyor crossings <br />could be included in the reclamation cost estimate. Please note that we had a typographical erzor in the <br />reclamation amount we previously provided for the conveyor crossing footing. The revised number is <br />included in the attached revised reclamation cost estimate information. <br />16. We have attached SW TKO's commitment to not remove any structures nor to encroach any closer <br />than the setbacks set forth in the stability analysis without authorization of the structure owner. We will <br />forward a copy of the surface use agreement with Kerr-McGee shortly. Associated facilities means any <br />of the tanks or permanent structures that KemMcGee may have in conjunction with the gas lines/wells. <br />The surface use agreement discusses this in more detail. <br />17. The end use for the reclaimed silt ponds will be pastureland. The silt ponds will be allowed to fill within <br />about 12" of the existing surface elevations. The operator will apply 12" of topsoil and seed the area <br />according to the seed schedule on the Reclamation Landscape Plan Map (we also typed this seed mix <br />out for you in our response to your March 8'^ adequacy review). This area will be graded consistent <br />with existing (pre-mining conditions). <br />18. The scale, scale house, batch plants, processing equipment, conveyors, and conveyor crossing <br />structures are all portable structures that the operator would take with them should they abandon the <br />site.
