L ucclony <br />Following is our response to your Adequacy Review dated April 8, 2005. As committed in our Mamh 23~ <br />submittal, we have enclosed the following: Cover Sheet Map (which has the revised permit boundary <br />description); the Existing Conditions Map (which has the structure owners on it); the information regarding <br />the reclamation calculations; and SW TKO's signed commitment not to remove structures on the property <br />until they own it. <br />1. We have notified the owners of land surfaces within 200 feet of the affected areas. These individuals <br />had the same comment period as the other people that we notified. <br />• The three landowners that own the recharge well properties wen; within 200 feet of the original <br />permit boundary, the new 200 foot radius did not reach any properties that had not already <br />received a notice. <br />We have removed the McCanne Ditch from the permit boundary to ensure that we do not increase <br />the acreage of the affected land. <br />• We had several neighborhood meetings about the proposed project prior to submitting the <br />application. We sent the mailing to owners of land surfaces within 200 feet and to many of the <br />people that attended the meetings. As a result, the owners of land surfaces within 200 feet of the <br />Ogilvie Seepage Ditch and the Porter Seepage Ditch have already been notified. <br />In the past, the Division has allowed us to submit the white receipts as proof of certified mailings as <br />long as they were officially stamped by the Post Office. We will copy all of the green receipts as well <br />and submit them under separate cover to ensure you have adequate time to review this letter. <br />2. Proof of publication is attached. <br />3. Documentation that adequacy responses and changes made to the application have been placed with <br />the Weld County Clerk to the Board of County Commissioners is attached. We will fax you the receipt <br />for this response on Monday. <br />4. Mr. Steve Brancucci owns the property listed as "Property Zone I-3 for sale." We have revised the map <br />to indicate his ownership. He has signed the legal right of entry and mailed it to us.
