COLORADO 81212
Energy Fuels Coal, Inc.
Mr. Alan Weaver
Southfield Mine
1190 County Road 92
Florence, CO 81226
RE: CERTIFICATION OF SEDIMENTATION POND NO. 5, SOUTHFIELD
MINE, FLORENCE, COLORADO (2nd Quarter, 1999)
Dear AI;
On June 22, 1999, an inspection was conducted on the Sedimentation Pond No. 5
currently in place at your Southfield mine. The inspection was performed by myself, John
Effinger III, a registered professional engineer in the State of Colorado since December,
1975. I have experience and knowledge in the design and construction of dams, drainage
control, hydrology and structures; including experience in portions of the permitting
process of coal mine facilities and permit compliance.
The purpose of this inspection and certiScation was to check for structural
weakness, erosion, other hazardous conditions and identify required maintenance and to
satisfy the requirements of Rule 4.05.6 (13) of the Colorado Mined Land Reclamation
Boazd for Coal Mining. In addition to the on site inspection referenced above, actions
taken in preparing this certiScation included review and discussion of applicable mine
maps and state regulations with yourself.
Said inspection was performed on a warm and stmny (80°), Tuesday afternoon by
myself. Most of the site was traversed with a two wheel drive vehicle with frequent stops
and hiking trips over, across and azound the structure. The following is a statement of my
professional observations and conclusions from this inspection:
The entire pond was examined for structural weakness, erosion, and other
hazardous conditions; none were found.
Existing water level in the pond was neaz the bottom ofthe pond decant gate. High
water mazk was neaz the emergency spill elevation.
Small erosion rill on east bank, slightl}• wide at top, has not widened.
