COLORADO 87272 <br />Energy Fuels Coal, Inc. <br />Mr. Alan Weaver <br />Southfield Mine <br />1190 County Road 92 <br />Florence, CO 81226 <br />RE: CERTIFICATION OF SEDIMENTATION POND Lz (WEST) AT <br />"LOADOUT", SOUTHFIELD MINE, FLORENCE, COLORADO <br />(2nd Quarter, 1999) <br />Dear Al; <br />On June 22, 1999, an inspection was conducted on the Sedimentation Pond L~ <br />(West) at the "I.oadout" area, neaz County Road 79. The inspection was performed by <br />myself, Sohn Effinger III, a registered professional engineer in the State of Colorado since <br />December, 1975. I have experience and knowledge in the design and construction of <br />dams, drainage control, hydrology and structures; including experience in portions of the <br />permitting process of coal mine facilities and permit compliance. <br />The purpose of this inspection and certification was to check for structural <br />weakness, erosion, other hazardous conditions and identify required maintenance and to <br />satisfy the requirements of Rule 4.05.6 (13) of the Colorado Mined Land Reclamation <br />Board for Coal Mining. In addition to the on site inspection referenced above, actions <br />taken in preparing this certification included review and discussion of applicable mine <br />maps and state regulations with yourself. <br />Said inspection was performed on a warm (80°), partly cloudy, with sprinkles and <br />lightening, Tuesday afternoon by myself. Most of the site was traversed by hiking trips <br />over, across and azound the structure. The following is a statement of my professional <br />observations and conclusions from this inspection: <br />The entire pond was examined for structural weakness, erosion, and other <br />hazardous conditions. At this inspection, a lazge crack in the south dam wall was <br />observed on top. The crack in the soil is about 1 inch thick and is in the north face <br />of the top of the dam, in the southwest corner. <br />The pond was dry and contained no water at the time of this inspection. <br />
