DANIELSON <br />Slate Engineer <br />.!1 ~_ <br />Fr'e~ " ~Sv0 <br />As requested, we have reviewed the above referenced application for a permit <br />to mine sand and gravel on 78 acres along the Arkansas River, eight miles east <br />of Puebla, Colorado, in Pueblo County. The applicant proposes to create ten <br />acres of ground water ponds in the next ten years. The ponds created are to <br />be reclaimed as wildlife habitat. <br />Using an impoundment of water for recreational purposes, including fishery and <br />wildlife, has been defined in Section 37-92-103, CRS (1973), as putting the <br />water to beneficial use. Since the source of water for the ponds that will be <br />created by the gravel pit operation is ground water and the ground water will <br />be used beneficially, we require that a well permit be obtained from our <br />office. The well permit must be obtained prior to excavation of the gravel <br />pit. Otherwise, Southwest Reaay-Mix will be in violation of Section <br />37-90-137, CRS (1973). Since the proposed gravel pit would be located in an <br />over-appropriated basin, the well permit could not be obtained until a court <br />approved plan for augmentation has been developed. <br />The applicant proposes to purchase water for dust suppression and other mining <br />purposes from the City of Pueblo Board of Water Works. Southwest Ready-Mix <br />will not be able to use water in the pit for the mining operation unless <br />replacement water for the additional consumptive use is included in the plan <br />for augmentation. <br />In a letter dated January 9, 1986 to our office, Southwest Reaay-Mix states <br />plans to use 30 acre-feet per year of water from well permit no. 10328-R <br />purchased from Rich and Company to augment for evaporation losses. Unfortu- <br />nately, this water would not be an acceptable replacement of evaporation <br />losses of the permanent ground water ponds. As stated by Southwest Ready-Mix, <br />
