The tank will be placed within a containment basin and such storage will be <br />performed in compliance with MSHA regulations. <br />Yow paragraph sixteen (Part l): See "Yow pazagraph twelve" discussion above. <br />Yow paragraph seventeen: Sierra believes that further movement of waste dump material from <br />the steeper slope drectly east and north of the main quarry portal is possible and quite likely. <br />However, Sierra does not consider this to be hazardous to its operation or that its operations will <br />affect this slope. The portal access road to the north of the main portal is constructed on a natwal <br />and man made bedrock bench, so sloughing of the waste below this azea will have no affect on <br />Sierra's operations. The road is on fill to the south of the main portal, but there has been no <br />significant movement of the fill in this azea since the time the quarry access road was constructed <br />in 1990. Sierra hopes that the CYMC forfeited bond funds can be used to stabilize this slope as it <br />will result in the prevention of any of the waste slope material from moving onto neighboring <br />property. Even if slope stabilization is not accomplished with these fiords, Sierra's operations will <br />not affect this area and Siena plans no slope stabilization activities. Sierra has excluded the azea <br />from the affected area in response to yow concerns. <br />Exhibit D -Reclamation Plan <br />Yow paragraph fow: I have changed the wording of this to specify screens azound newly planted <br />shrubs and trees. <br />Yow pazagraph six (Part e): The drainage pipe shall be schedule 80 PVC designed for burial. <br />The pipe will be buried from the intake inside the quarry, under the access road, then it will run on <br />surface down the slope to the sediment pond. <br />Yow paragraph seven: The pond will be cleaned out with a backhoe if access is available. <br />Otherwise it will be dug out by hand. The funds included in the reclamation budget are sufficient <br />to cover either option. <br />Exhibit E - Minine and Reclamation Map <br />Yow paragraph one: The pipe is on a fairly constant downslope going directly east from Entry <br />No. 3 to outfall 001 at Yule Creek. <br />Yow paragraph two: The map has been modified to show that existing slopes may remain at <br />1.6:1, but any new waste disposal will have slopes of 2:1 or less. <br />Yow paragraph three: The jeep trail has, for the most part, been covered by waste dumped by <br />CYMC. CYMC was careful to keep open a path upon which a large backhoe can still walk down <br />to the sediment pond. This is the path that can be used to do any cleanup work or slope <br />stabilization at the toe of the waste pile. After this work is done, and after the sediment control <br />structwe is rebuilt, Sierra will use this path to begin to deposit waste according to the reclamation <br />plan sequencing. There will be a short period, lasting possibly one yeaz, during which time this <br />path will have had heavy traffic from the loader. If, for some reason, Sierra fails during this time, <br />
