The issuance of this permit does not ensure that <br />no injury will occur to another vested water right or predude another owner of a vested water right from seeking relief in a dull court actlon. <br />2) The consWctton of this well shall be in compliance with the Water Well ConsWCtton Rules 2 CCR 402-2, unless approval of a variance has <br />been granted by the Spate Board of Examiners of Water Well ConsWctlon and Pump Installatlon Contractors In accordance with Rule 18. <br />3) Approved pursuant to CRS 37-90-137 (2) and (11) for an existing well (gravel pit pond) In accordance with the Centlal Aggregates, Inc. plan <br />for augmentallon approved by the Division 5 W ater Courtin case no. 03CW290 for the West Rifle Pit. If this gravel pit is not operated in <br />accordance with the terms of said decree, It will be subject to adminstratlon, (nduding orders to cease diverting water. <br />4) The approval of this permit does not gent a water right. This well (gravel pit pond) is subject to administra8on by the Division Engineer in <br />accordance vAth applicable decrees, statutes, rules and regulations. <br />5) The averega annual amount of ground water to ba appropriated shall net exceed 62.19 acre-feet with the total surface area of the proposed <br />ground water pond limited to 20.6 aces. <br />6) The use of ground water, In addition to evaporation, is limited to recreational and piscatorial puryoses. No other use of water is allowed <br />unless a permit therefor is approved. <br />7) The owner shall mark the well (gravel pit pond) In a conspicuous place with well permit number(s) and court case number(s) as appropriate. <br />The owner shall fake necessary means and precautons to preserve these markings. <br />B) A totalizing flow meter must be Installed so as to measure any pumping from this gravel pit pond and maintained in good working order. <br />Permanent records of all dNersions'trom the gravel pit pond, the surface area of ground water exposure shall be maintained by the well owner <br />(recorded at least annually) and submitted to the Division Engineer upon request. <br />9) Pursuant to Rule 10.1.6 of the Water Well ConsWdlon Rules, gravel pit wells are exempt from the minimum well consWCtlon standards <br />except for contaminatton consWeretlons as stated In the Rule. The owner of the gravel pit shall take necessary means and precautions to <br />event wntaminants from entering the gravel pit well. <br />10) ursuant to Rule 17.1.4 of the Water Well Construction Rules, the owner shalt submit, after initladon of construction, site plan and cross <br />sec8on drawings on ~1l2" x 11" paper show(ng the extent of intended excavatlon, the maximum depth of the pit, and the Initial static water <br />level. - <br />11) The boundaries of the gravel pit pond shall be more than 600 feet from any exlstlng well, completed In the same aquifer, that is not ovmed <br />by the applipnt. <br />12) Pursuant to Policy 2000-4 of the State Board of Examiners of Water Well Construction and Pump Installation Contractors (Board), no pumping <br />equipment shall be installed in the grevel pit well to withdraw water for any benefidal use, unless a separate written request for a variance has <br />been approved by the Board. <br />13) The Issuance of this permit hereby cancels permit no. 42041-F. <br />NOTICE: This penult has been approved for a loptlon in Range 93 WEST and 62.19 acre-feet per year, as spedfted In Exhibit 4 of rase no. <br />03CW290. You era hereby nofifted that you have the right to appeal the Issuance of this permit, by filing a written request with this office <br />within sixty (60) days of the date of issuance, pursuant W the State Administrative Procedures Act.
