<br />EXHIBIT C, Section (k): You have committed [o notifying various departmental officials if you <br />encounter refuse or acid or toxic producing materials but this section requires a description of how such <br />materials, if exposed, will be handled and disposed of, not simply reported. Please also be advised that <br />there is no Colorado Department of Environmental Quality. <br />Please contact the appropriate agency(s) and then indicate how you intend [o handle and dispose <br />of such materials, if encountered, in order to meet appropriate State requirements. <br />EXHIBIT C, Sections (n) and (o): You have not provided responses to these sections. <br />Please zither provide responses [o these sections or indicate that they do no[ apply to your <br />operation. <br />EXHIBIT D, Section (c): You have indicated that fertilizer will be used if soil conditions warrant <br />but you have not indicated how you wil! determine if soil conditions warrant the use of fertilizer. <br />Please commit to conducting a soil test (as the NRCS recommends) and [o submitting it, together <br />with your proposed fertilizer or a proposal not to employ fertilizer, to the Division for review and approval. <br />Altematively, you could commit [o employing the fertilizer recommended by the NRCS. <br />EXHIBIT D, Section (c): You have staled [hat the seedbed will be mulched as needed. You have <br />not, however, indicated how a need for mulch will be determined. <br />Please indicate under what conditions the seedbed will be mulched and, if a need for mulch is <br />found to exist, what kind of mulch will be used, the crimping method and rate of application. Altematively, <br />you could commit to following the recommendations ofthe NRCS. <br />EXHIBIT E, Mining Plan Map: The Exhibit C Mining Plan is required to be consistent with the <br />Exhibit E, Mining Plan Map, If, as suggested by the responses provided under Exhibit C, there is to be an <br />area excavated below groundwater level so that mining is carried on in a wet pit, the limits of that wet pit <br />are not illustrated on the Mining Plan Map. <br />If mining in a wet pit is intended, the Mining Plan Map should be revised to show the limits and <br />depth of that pit. <br />EXHIBIT E, Reclamation Plan Map: The Mining Plan and Reclamation Plan Maps have been <br />combined in the application which is not recommended, but since the combined map is large enough to <br />show all the requred features, it will be accepted. The illustration of the 3: I slope forming the southern <br />boundary of the pit, however, is shown as running directly into the permit area boundary. Accomplishing <br />this without mining or disturbing area outside the permit boundary is unlikely. <br />The Reclamation Plan Map should indicate a more realistic relationship of the 3:1 reclaimed slope <br />to the permit area boundaries. <br />EXHIBIT J: You have provided acceptable evidence of the mailing and receipt of a Notice of <br />Permit Application to the Lincoln County Board of Commissioners but not to the Board of Supervisors of <br />the High Plains Soil Conservation District. Evidence of mailing a Notice of Permit Application [o the <br />National Resource Conservation Service Office dots no[ meet the requirements of this exhibit. <br />Please provide evidence of the receipt of a Notice of Permit Application by the High Plains Soil <br />Conservation District. <br />
