RE: Required Scope of Work for Determining the Presence of Alluvial Valley Floors and
Hydrologic Baseline Studies for Determination of the Probable Hydrologic
Consequences with Regard to the Allen/Maxwell Proposed Decision and Findings of
Compliance to be Public Noticed on December 14, 1983.
Dear Mr. Shelton:
The conditions of the Maxwell i,Aine, Permii C-013-81 and the Allen Mine, Permit C-
012-81 found in the Proposed Decision and Findings of Compliance Document to be
published for public notice on December 14, 1983 state:
"The Division is proposing to approve, with stipulations, surface activities and
development mining operations only. Prior to approval of secondary or retreat
mining, the permittee will have to resolve informational deficiencies and secure
Division approval through the Revision process".
It is the intent of this letter to o~~tline the scope of work necessary to resolve these
informational deficiencies and secure Division approval through the Revision process
required to allow secondary or retreat mining.
SCOPE OF WORK
Alluvial Valley Floor Determination
The Division has determined that Apache Canyon and Santistevan Canyon are
alluvial valley floors (AVF) based on the assumption of subirrigation. This determination
was made on a conservative basis by the Division because of a tack of site specific
information. To fulfill the informational deficiencies it will be necessary for Wyoming
Fuel Company to establish the presence or absence of subirrigation.
The AYF determination for these Canyons will be removed if 1Vyoming Fuel
Company establishes the absence of subirrigation. The AVF determination will not be
removed if Wyorning Fuel Company establishes the presence of subirrigation. Wyoming
Fuel Company reserves the right to demonstrate that these areas meet the requirements
for grandfathering by supplying additional information as stated on page 42, under Alluvial
Valley Floor Exemption of the Allen and Maxwell Proposed Decision and Findings of
Compliance Documents.
