': <br />Mr. David Shelton ~ ;__;_ ,i }GS;~3 <br />Colorado Mined Land Reclamation Division y <br />1313 Sherman """ ~!`"' `"C':'~"fiTinN n;ItISi0P1 <br />Denver, Colorado 80202 <br />RE: Required Scope of Work for Determining the Presence of Alluvial Valley Floors and <br />Hydrologic Baseline Studies for Determination of the Probable Hydrologic <br />Consequences with Regard to the Allen/Maxwell Proposed Decision and Findings of <br />Compliance to be Public Noticed on December 14, 1983. <br />Dear Mr. Shelton: <br />The conditions of the Maxwell i,Aine, Permii C-013-81 and the Allen Mine, Permit C- <br />012-81 found in the Proposed Decision and Findings of Compliance Document to be <br />published for public notice on December 14, 1983 state: <br />"The Division is proposing to approve, with stipulations, surface activities and <br />development mining operations only. Prior to approval of secondary or retreat <br />mining, the permittee will have to resolve informational deficiencies and secure <br />Division approval through the Revision process". <br />It is the intent of this letter to o~~tline the scope of work necessary to resolve these <br />informational deficiencies and secure Division approval through the Revision process <br />required to allow secondary or retreat mining. <br />SCOPE OF WORK <br />Alluvial Valley Floor Determination <br />The Division has determined that Apache Canyon and Santistevan Canyon are <br />alluvial valley floors (AVF) based on the assumption of subirrigation. This determination <br />was made on a conservative basis by the Division because of a tack of site specific <br />information. To fulfill the informational deficiencies it will be necessary for Wyoming <br />Fuel Company to establish the presence or absence of subirrigation. <br />The AYF determination for these Canyons will be removed if 1Vyoming Fuel <br />Company establishes the absence of subirrigation. The AVF determination will not be <br />removed if Wyorning Fuel Company establishes the presence of subirrigation. Wyoming <br />Fuel Company reserves the right to demonstrate that these areas meet the requirements <br />for grandfathering by supplying additional information as stated on page 42, under Alluvial <br />Valley Floor Exemption of the Allen and Maxwell Proposed Decision and Findings of <br />Compliance Documents. <br />
