Colorado Department of Health <br />November 19, 2002 <br />Page 2 <br />Based on [he demonstrated success of reclamation, revegetation and the control of erosion at [he Golden <br />Eagle mine site, as reviewed and approved by the Division of Minerals and Geology and verified by a <br />Colorado Department of Health inspection, Basin Resources is requesting termination of all reporting <br />requirements (DMR's) under NPDES permit number COG-850040. Deactivation of Basin's coverage <br />tinder the NPDES permit is also requested. <br />Basin is also requesting exemption from the Stormwater monitoring requirement. Phase II release froth the <br />Division of Minerals and Geology requires in part that the run-off (water quality) from areas disturbed by <br />mining shall be no lesser than that of surrounding undisturbed acreage. Basin has demonstrated this to the <br />satisfaction of [he Division. <br />If these requests cannot be approved, please provide a written explanation of the regulatory requirement for <br />continued monitoring and reporting of facilities that have been removed from service and successfully <br />reclaimed. <br />Your review of this request is appreciated.
