RE: Phone Conversation with Randall Shepard on 1/22/99
On 1 /22/99, I received a phone call from Randall Shepard [phone]. Mr. Shepard
indicated that he had reviewed the Delta Paving Gravel Pit application, at the Delta County
Clerk & Recorder's Office.
Mr. Shepard inquired about the public comment period for the application. I stated that
the public comment period would close on 2/23/99. I stated that if DMG received written
comments in objection to the referenced application by 4:00 pm, 2123/99, DMG would
schedule an Informal Conference, Pre-Hearing Conference, and Formal Public Hearing. I
explained the purpose of each of the public meetings and that the first two meetings would
occur in the Delta area but the Formal Public Hearing would occur in Denver. I stated that
all persons who submitted comments within the comment period would be informed of the
scheduled meetings by mail and/or phone call.
Mr. Shepard stated concerns for flood potential to the proposed Delta Paving Gravel Pit,
located adjacent to the Gunnison River. Mr. Shepard stated that he had recently read an
article in a local paper which indicated that the USFS or National Parks Service intended to
schedule seasonal releases from reservoirs on the Gunnison River, in the magnitude of
10,000 to 15,000 cfs, to "flush out the canyon". Mr. Shepard stated that he had
witnessed previous flows on the Gunnison River, which resulted in flooding of portions of
the permit area proposed by the Delta Paving Gravel Pit application. Mr, Shepard indicated
that he did not think that such location was a good place for a gravel mining operation.
I informed Mr. Shepard that his phone call did not satisfy the requirements of a written
objection, necessary to trigger DMG public process. I stated that receipt of a written
objection, received prior to the close of the public comment period, 2/23/99, was required
before DMG could schedule the Informal Conference, Pre-Hearing Conference and Formal
Public Hearing.
Mr. Shepard indicated that he understood and that he would submit his objection in
writing.
