EOng <br />Division Dueclor <br />RE: Phone Conversation with Randall Shepard on 1/22/99 <br />On 1 /22/99, I received a phone call from Randall Shepard (970) 835-3374. Mr. Shepard <br />indicated that he had reviewed the Delta Paving Gravel Pit application, at the Delta County <br />Clerk & Recorder's Office. <br />Mr. Shepard inquired about the public comment period for the application. I stated that <br />the public comment period would close on 2/23/99. I stated that if DMG received written <br />comments in objection to the referenced application by 4:00 pm, 2123/99, DMG would <br />schedule an Informal Conference, Pre-Hearing Conference, and Formal Public Hearing. I <br />explained the purpose of each of the public meetings and that the first two meetings would <br />occur in the Delta area but the Formal Public Hearing would occur in Denver. I stated that <br />all persons who submitted comments within the comment period would be informed of the <br />scheduled meetings by mail and/or phone call. <br />Mr. Shepard stated concerns for flood potential to the proposed Delta Paving Gravel Pit, <br />located adjacent to the Gunnison River. Mr. Shepard stated that he had recently read an <br />article in a local paper which indicated that the USFS or National Parks Service intended to <br />schedule seasonal releases from reservoirs on the Gunnison River, in the magnitude of <br />10,000 to 15,000 cfs, to "flush out the canyon". Mr. Shepard stated that he had <br />witnessed previous flows on the Gunnison River, which resulted in flooding of portions of <br />the permit area proposed by the Delta Paving Gravel Pit application. Mr, Shepard indicated <br />that he did not think that such location was a good place for a gravel mining operation. <br />I informed Mr. Shepard that his phone call did not satisfy the requirements of a written <br />objection, necessary to trigger DMG public process. I stated that receipt of a written <br />objection, received prior to the close of the public comment period, 2/23/99, was required <br />before DMG could schedule the Informal Conference, Pre-Hearing Conference and Formal <br />Public Hearing. <br />Mr. Shepard indicated that he understood and that he would submit his objection in <br />writing. <br />
