<br />WHEREAS, by easement deed dated January 25, 1976, and
<br />• recorded on February 23, 1978, in Book 447 at page 592 of the
<br />records of the Clerk and Recorder of Ro utr County, co lorado,
<br />Grantors granted to W. R. Grace s Co., a Connecticut corporation,
<br />an easene nt (the "Easement"), and
<br />WHEREAS, by deed dated January 30, 1978, and recorded
<br />on February 23, 1978, in Book 447 at page 597 of said records,
<br />W. R. Croce 6 Co. conveyed the Easement to H-G Coal Company, and
<br />WHEREAS, Darrell S. Hockett, owner of record of an
<br />interest in the property subject to the Easement, and Darrel S.
<br />Hockett, one of the grantors of the Easement, are one and the
<br />same person.
<br />NOtJ, THEREFORE ,, for the purpose of confirming the grant
<br />of the Easement and in consideration of the sum of ten dollars
<br />to them in hand paid by the Grantee, the rec eipe and sufficiency
<br />of which is hereby confessed and acknowledged, Grantors by these
<br />presents do gran[, bargain, sell and convey unto the Oran tee,
<br />its successors and assigns, a perpetual easement for constructing,
<br />operating, maintaining and using a roadway for the movement of
<br />persons, vehicles, and property of all kinds and character on,
<br />over and across said roadway, including the right and privilege
