The <br />Division can not comply with this requirement for several reasons. These are: <br />I .) Per 40 CFR 434, a pemlit must be maintained for coal mining sites until "bond release". This has been <br />interpreted by the Water Quality Control Division as release from Phase III requirements under the <br />Division of Minerals and Geology ("DMG") coal mining regulations. To inactive the permit, we will <br />need verification from DMG that the bond has been released. It is clear from your letter that a point <br />sotuce still exists. <br />2.) The Division does not have you or your organization listed as the legal contact for the permit. The <br />Division can not proceed with any changes in the permit status unless they are submitted by the legal <br />contact. <br />Since, according [o your Ic[ter, the site is not longer active, and the site has been returned to the contours <br />required by DMG, the site would qualify for the post mining effluent limitations listed in the general coal <br />mining permit. In order to be covered by these less stringent requirements a letter must be received from the <br />legal contact requesting the change to post mining. The letter should also provide supporting information that <br />the site has been contoured and revcgetated. <br />f have also attached a change in ownership which must be completed if you are [o assume the responsibility of <br />[his pemlit. <br />
