The
Division can not comply with this requirement for several reasons. These are:
I .) Per 40 CFR 434, a pemlit must be maintained for coal mining sites until "bond release". This has been
interpreted by the Water Quality Control Division as release from Phase III requirements under the
Division of Minerals and Geology ("DMG") coal mining regulations. To inactive the permit, we will
need verification from DMG that the bond has been released. It is clear from your letter that a point
sotuce still exists.
2.) The Division does not have you or your organization listed as the legal contact for the permit. The
Division can not proceed with any changes in the permit status unless they are submitted by the legal
contact.
Since, according [o your Ic[ter, the site is not longer active, and the site has been returned to the contours
required by DMG, the site would qualify for the post mining effluent limitations listed in the general coal
mining permit. In order to be covered by these less stringent requirements a letter must be received from the
legal contact requesting the change to post mining. The letter should also provide supporting information that
the site has been contoured and revcgetated.
f have also attached a change in ownership which must be completed if you are [o assume the responsibility of
[his pemlit.
