I think it best at this time to request an additional sixty <br />days or until May l8, 2001 for the decision date in this matter. <br />In the meantime, I will attempt to address the concerns in your letter of December 28, 2000 in the <br />order that you presented them. <br />.. The maps will be re-done to correct the deficiencies and clear up the discrepancies at items 1 <br />through 3. <br />Exhibit B, index map, is being re-submitted (original and four copies) to Suzie to be inserted in <br />the application in lieu of the ones there. The boundary of the unpatented claims has been <br />eliminated. The affected land area and the property boundary are the same. <br />The pre-mining map and mining plan map will be the same and will show all features, natural and <br />man made, on the property. The triangle containing the siltation or decant pond will be included <br />in the boundary (affected land) as will Forest Service Lands. The common comer for Sections 4- <br />5, 32-33 or point of beginning for the easements will be shown. <br />The off-site easements are n part of the affected land. They existed prior to the permit <br />J(r application, contain water bars and are bermed. They will be maintained but not substantially <br />upgraded and will be left as is to the owner for access to his upper property, as per his request. <br />The map at Exhibit A will be re-submitted to eliminate the unpatented mining claims boundaries <br />on Forest Service land. This map shows the surface owners of record and I would like it used for <br />[hat purpose also. <br />The mining plan map will show the direction of mining of the spoils pile. There should be no <br />excavated overburden material while mining the spoils pile that would be temporarily stockpiled. <br />As to yotu pazagraph 7, it is the plan to remove the entire spoils pile. I was unable to find any <br />pictures, maps or persons who could tell me what the spoils pile area looked like prior to its <br />deposit. I assume that the floor is basically flat, grading slightly to the northeast. I have no idea <br />
