Issues of Concern

• Inconsistency between term of lease for operator and duration of 112 Reclamation
Permit, and delegation/assignment ofresponsibility by concerned parties for mining,
rehabilitation and reclamation permit conditions.
• Clarification of conditions pertaining tb setback ofmining operations from property
boundaries.
• Clarification of allowable/required mining depth and required degree of extraction of
resource to diminish total disturbed surface area. Related potential impacts ofmining
on neighboring surface and subsurface water rights, and other drainage-related issues.
• Mining plan inconsistencies with conditions of Custer County Special Use Permit and
explicit recommendations of Colorado Division of Wildlife.
• Potential changes in USACE comments regarding CWA 404 permit requirements,
due to upcoming field visit (reference: letter dated Mazch 14, 2003 from John Gerstle
to Van Truan, Southern Colorado Regulatory Office, USCOE).
• Lack of description of source of water for washing and treatment of mined aggregate.
• Request for permission to mine and sell topsoil, rather than conservation for mine
rehabilitation and reclamation.
• Potential water quality impacts of asphalt and concrete processing facilities described
in application.
