UPDATE <br />Thrs is jor the renewal ofthegeneral sand and gravel permit fast issued on Octoberl8, 1982, with reissuanceson June /0,1987, August <br />31, /992, and August 31, 1997. The General Permit system for regulating sand and gravel production operattons has worked wel/for <br />the State ojColorado. <br />The following minor changes have been made to the permit and Rationale during renewal: <br />A. Small MunicioaliNExemption: The Rationale discussion onrhestormwaterpermittingExemptionsfarSmal/Municipalities <br />(Section IILB) has been changed to include the March 10, 1003 deadline for permit coverage for municipally owned <br />industries. This did not involve any changer to the permit. <br />B. Reaoolication: Authorization to discharge under this general permit will expire on September 30,1007. For certifications <br />covering stormwater discharges only (i.e., the permiaee's individual certification does not indicate that Pan I.B of the <br />permit must befollowed), the deadlinejor reapplication jor continued coverage underYltegeneral permit has been changed <br />to ninety-days prior to permit espiradon, o~June 30,1007. The due date for perminees certified to discharge stormwater <br />and process water will remain as 180 days before permit expiration, or March 31, 1007. <br />C A paragraph was included in the introductory page explaining the right of anyparry to an adjudicatory hearing contesting <br />the renewal ojthis general permit, as per the Colorado Discharge Permit Svstem Regulations. Regulation No. 61, (5 CCR <br />1001-61). Note that this does not provide for an adjudicatory hearing for a certifrcatton issued under this general permit. <br />D. Imoacted Stream Se enu: For this general permit, any existing or new operation that discharges [o a segment that is listed <br />on the Division's 3030 list of impacted stream segments may requre an individual permit The 3030 segments are <br />segmentr in which water quality standards for one or more pollutants are exceeded. <br />For most, ifnot all, ofthe operations that discharge under this permit, there are no monitoringdata to verifylhe espectatian <br />that these discharges will not impact a listed segment Therefore, for those facilities that discharge process water to <br />segments on the 303(d) list, rhepermittees will be required to perform a One-rime analysis upon Commencement ofducharge <br />jor the listed parameters of concern to confirm that stream standardsjor these parameters are not exceeded in the discharge <br />concentrations. <br />Where the receiving water rs included on the state's 303(d) list, rota! maximum daily loads (TMDls) are being developed in <br />accordance with the Division's schedule jor TMDL complefion. Once a TMDL has been established, if it is necessary to <br />incorporate /imitations for a facility certified under this general permit which are based upon the outcomes of the TMDL or <br />the results ofrhe one-time analysis, an individual permit may be written to regulate dischargesfrom ihrsjaciliry. Thefacility <br />would continue to be covered under this general permit certification until the individual permit is issued. <br />STORMWATER PROGRAM <br />As required under the Clean Water Act amendmenu of1987, the Environmental Protection Agency (EPA) has established a framework <br />jor regulatingmunicipalandindustrialstormwaterdischarges. ThisframeworkisundertheNationalPollutantDischargeElimination <br />System (NPDES) program. The regulations (40 CFR !12.26) require speck types of indusbial facilities which discharge stormwater <br />associated with industrial activity (industrial stormwater), to obtain coverage jor this discharge under an NPDES permit. Faciltries <br />which discharge industrial stormwater either directly ro surface waters or indirectly, through municipal separatestorm sewers, must be <br />covered by a permit. <br />
