RE: 200 ft. Structure Agreements with Surrounding Structure Owners to Turnpike
Mining Resource DMG Application: M-2004-009

As part of the Turnpike Mining Resource DMG Application/Permit No. M-2004-009,
several Structure Agreements will need to be approved by the owners of those structures
prior to the applicant/operator (ASCI) mining within 200 ft. of the structures.
ASCI commits to obtaining those agreements, or "sign-ofP' by a registered engineer, that
no damage will occur to those structures by the operator, prior to the operator mining
within 200 ft. of the structures. If no agreement from the owner of the structure can be
obtained, or geotechnical stability report can be procured for safety to the structure, ASCI
commits to not mining within 200 ft. of the structure in question.
All man-made permanent structures within 200 ft. of the permit boundary are shown on
Exhibit C, Sheet 2 and all owners of permanent man-made structures within 200 ft. of the
proposed affected land are listed in Exhibit S, "Permanent Man-made Structures".
Owners of those structures are natucal gas transmission companies, oil and gas
production companies, electrical and telephone communication companies, and the
owners of the Godding, Daily and Plumb Ditch.
