22 <br />-s <br />CONCLUSION <br />When retreat mining occurs under the Minnesota Creek drainage, some land <br />1 subsidence is expected. It is unknown at this time if this subsidence will <br />effect the natural runoff of either Dry Fork or Lick Creek. The proposed <br />augmentation plan assumes a worst case condition where there will be no <br />runoff from any land above the mining operations. If that occurs, there <br />1 will be injury to some vested water rights. To guard against any possible <br />J injury, ARCO has acquired ownership or control in over two dozen decreed <br />J water rights in the Minnesota Creek basin. These rights have historically <br />diverted over 15% of all water that has historically been diverted from <br />l Nlinnesota Creek. <br />If the augmentation plan, as described by the above eleven steps, is <br />] followed, wp believe that all of the vested water rights in the Minnesota <br />Creek Basin will be protected from any potential injury from land subsidence <br />l• caused by Mt.
