Gunnison No. 1 Coal Mine and a vested water right is injured, then WECC <br />must compensate for that injury. It is proposed that WECC will utilize the <br />' water rights it owns in the Minnesota Creek basin to mitigate injury to <br />other water users. <br />Figure 2 is a schematic flow diagram of how the augmentation plan would work <br />' when there is retreat mining under Dry Fork and Lick Creek. The following <br />description of how the plan operates parallels the flow diaoram in Figure 2 <br />PLAP+ OF AUG~4ElaTATIUN <br />' Step 1. Is there retreat mining under the Dry Fork? <br />• If the answer is nc, then no augmentation is required. <br />Augmentation may be required if there is subsidence. No <br />subsidence is anticipated until retreat mining has occurred. <br />' Step 2. Is there a valid water right call on Minnesota Creek? <br />' If the answer is no, then no augmentation is required. <br />If there is a valid call, then it is necessary to proceed with the <br />calculation of how much water is needed for augmentation. <br />1 <br />1 <br />• <br />
