<br />1997, we will advance to secure a Trustee within ninety (90) days of the signature <br />date of the OSE on this Letter of Intent. Within one (1} year of this dat we trust <br />that the principal components of a Master Temporary Plan of Augmen ation can <br />be in place as well. I have used one year since an Individual Plan w initiated <br />in May of 1996, and is still pending final approval. Drawing upon t e unique <br />nature of a Master Plan, it seems reasonable to assume a similar time f ame. <br />While target dates are specified in the commitment, the saUsPactl n oP this <br />agreement should not be tied to dates since there are diverse playe s whose <br />commitments may require a timeline longer than that targeted. As Ion as Varra <br />Companies, Inc. provides a good faith effort to effect this letter of agr ment by <br />its actions, the agreement should not be jeopardized by dates tha may be <br />obstructed for the greater good of obtaining a sound and thorough r view and <br />placement of all other players and tangent agreements necessary to ffect the <br />same. <br />The provision of 'wet water in trust' is established first by 'Intent,' as evid nced by <br />this letter, and second, 'in fact,' by the establishment of a 'Trustee.' It is a pre- <br />requisite that secures the Time necessary to: (1) enable extraction a ivities to <br />proceed without delay and undue expense; and, (2) set in m tion the <br />development of a Master Temporary Substitute Supply Plan. <br />It is in fact the Master Plan that is the greater purpose of this Letter of Int nt. The <br />development of a Master Plan will reduce the drain on everyone's res urces by <br />reducing the time and energy necessary to assess future circu stances. <br />Assumptions will be established that can be plugged into the basic Ma ter Plan. <br />The replacement issues will be satisfied by the water held in trust, unt I the site <br />specific nature of each operation can be evaluated under the Plan. <br />For example, a certain quantity of water is made available under an exi ing right <br />controlled or owned by the operator. Two future sites are opened at two <br />separate locations within the Theatre of Operations. Since the entire T eatre of <br />Operations is small enough in scope, basic assumptions of pan eva oration, <br />crop usage and consumptive use can be generalized over the are without <br />compromising applied values. Therefore, if a known value for a po ion of a <br />share of a water right can be applied against a known consumptive use value in <br />the area, those values are converted to exposed surface acres and di tributed <br />monthly. <br />In this manner, existing and future replacement needs are tied to tota surface <br />acres exposed and planned for exposure in the forthcoming year.
