. • 11 <br />Af[idavlt of Agreement between the Colorado Divlslon of Water Resources - 0 fice of the <br />State Engineer and Varra Companies, Inc., to the effect that: <br />I. The OSE acknowledges its approval of this Letter of Intent by si nature of <br /> Hal Simpson, State Engineer, below. <br />2. The signed Letter of Intent signifies that Varra Companie , Inc. is <br /> progressing toward full compliance with Senate Bill 120, and th t water is <br /> identified and will be held in Trust to be established for pu poses of <br /> satisfying an approved Master Substitute Supply Plan. <br />3. Components necessary to establish a Trustee and Manager of ater held <br /> in Trust will be initiated within 90 days of the signature da of this <br /> agreement to assure water is available for the intended purpo a of the <br /> temporary substitute supply for augmentation and held or ma aged to <br /> remain uncompromised for return to Varra Companies, In for its <br /> traditional use. <br />4. During the establishment of the Trust, Varra Companies, Inc. ill make <br /> good faith efforts to gain comments from all Contacts for the co ponents <br /> of a Master Plan and develop a first Draft for joint review and co ment by <br /> 15 May 1997. <br />5. A Final Draft with all major components and agreements n place, <br /> including provisions for Winter water will be generated by 1 J ly 1997, <br /> conditional upon a timely and complete response by all Contacts. <br />6. Obtain Final Approval of the Master Plan, pending final com ents or <br /> conditions specified by the State Engineer and as agreed to y Varra <br /> Companies, Inc.• <br />7.
