Long <br />Dimaon Dkeclor <br />RE: File No. M-99-050, Timnath Connell Pit, 112c Decision Letter -Conditions, Financial and <br />Performance Warranty Request -Construction Material Operation <br />Dear Mr. Connell: <br />On September 22, 1999, the Division of Minerals and Geology approved your 112c mining permit <br />application. The conditions to the approval are noted below: <br />Stipulation No. Description <br />The Applicant must keep excavations at least two feet above the maximum groundwater <br />elevation until a Substitute Water Supply Plan is approved by the Office of the State <br />Engineer and proof of this approval is submitted to the Division. <br />2. If the depth of excavation exceeds 16 feet, and excavation is within 200 feet of any <br />significant, valuable, and permanent man-made structures not owned by the Operator, <br />the amount of required mining setback to the structure or right-of-way will be increased <br />as necessary to be two-times the depth of the excavation. <br />3. The total amount of financial warranty required for permit issuance is set at $510,198.00. <br />Upon the submittal and approval by the Division of a Technical Revision which <br />includes a set of standards and specifications and a quality assurance plan for the lining <br />of the pit the financial warranty will be recalculated. <br />4. The Operator shall mine and backfill the northeast comer of the permit azea prior to <br />mining activities in Phase 4. The crest of the backfill must be at least as high as the <br />adjacent undisturbed areas and must be at least 400 feet from the crest of the bank at <br />bank full stage of the Cache La Poudre River. <br />5. The Operator shall develop, in consultation with Mr. Swifr, a contingency plan for <br />assuring delivery of water to Mr. Swift, and shall submit the plan to the Division within <br />90 days of [he effective date of this Order. The Division shall have 60 days to review <br />the plan and decide on the plan's sufficiency. <br />
