W MINING INC.
..~,o„~,...~~~.
May 26, 1999
Ms. Christine E. Johnston,
Environmental Engineer
Mountain Coal Company, LLC
P.O. Box 591
Somerset, CO 81434
RE: Right of Entry
Dear Christine:
Oxbow Mining, Inc. ("OMI") is aware that Mountain Coal Company, LLC's __
("MCC") permiYboundary north of the North Fork of the Gunnison River overlaps
with OMI's south property and permit boundaries in Sections 9 & 10, T13S,
R90W, 6'" P.M. It appears that this boundary also overlaps with the Union
Pacific Railroad and Colorado Department of Transportation's old and new
Highway 133 rights-of-way in this location. Being that MCC's north permit
~' : boundary generally coincides with the public highway right-of-way and railroad
right-of-way (leased by MCC and OMI), MCC's right to enter these lands is for
the most part provided by these rights-of-way. However, should MCC propose a
specific use of these lands (whether on previously disturbed or undisturbed
lands), MCC should request OMI's authorization for such uses of OMI's property.
Sincerely,
WAt i EG ~..
