Milte Shemtetr (Field Habitat
Biologist) and Larry Rogstad (D~vtrict Wildlife Merrager) have reviewed this Rec]amation Permit Application
From and made a 5eld visit to the proposed amended trlrtle site in Deccrrlber 1999. The proposed mmmg
project will elb'ect a relatively large amount of acreage and we believe there is a very higtl potemial to
nrgatively iatpact wildlife atd/or wildlde habitat. We have tnajor concerns tegardmg the wetland ahetation
and its effect on both aquatic and terrestrial wildlife. We have had these wrrcerns over the past 11 years as
evidenced by the eacbsed letters written by Larry Rogstad to the Weld County Departrrterrt of Planning
Services arri Tuttle Applegate Lrrc. The sarrle corcertLS tenleirl today and 1 ask you to please spend the rime
read"mg these letters is detail.
We believe that Cetl 4 end Cell A contains excellent riparian habitat due to the fact that it is in within the ! 00
year flood plain and u directly associated with the Cache Ia Poudre river bottorn We highly rexomrnend that
the warm water slough be albwed to remain m its currert condition Our second preference would be for
the existeDCe an intact warm water sough after final reclamation if the west end of the property is to be
t[itrled.
Of particular cot>cern u the potential for disturbance to the existing and active Great bhre heron (Arden
herodias) cobrry boated abng the southwest side of Cell A. These buds are very sensitive to human
disturbacees, utcluding huulen uttrusion into colonies, actively used roads, mining activity, road construction
and urbani2atiorL Disttubartce rrmy cause aberdonment ofnests and roosts atd may prevent aduhs from
adequately Seeding juvetules and themselves (Ehrlich et al. 1988). Buffer zones around breeding cobnies of
820 feet (250 m) on land and 492 feet (150 m) in water are t+ecorrmraded (Colorado; Vos et al. ~. DeMalao
1993). Additionally, restricting httmen activity, especially early in the breeding season, i9 recommended for
those sites at which it h dif5cuh to establish buffer zoces. Buffer zotles should 6e established prior to the
breeding season (mid-February) and maintailted unN early August when sites have been deserted for the
year.
DEPARTI~NT OF NATURAL RESOURCES.
