In addition, a number of Moffat county roads were also impacted by the severe flooding and, in
some places, overtopping and compete wash outs.
Conclusion
We respectfu{{y request that the Division consider and accept the above information as
additional burden of proof information relevant to the subject discharge. We have shown that,
based upon the actual volume of water discharged from Pond 007A, the discharge from the
pond occurred as a result of a snowmelt runoff event which substantially exceeded the approved
design for the 10-year/24-hour inflow event. As such, we believe Colowyo was in full
compliance with the terms and conditions of our CDPS Discharge Permit.
We have also provided information showing that the flooding not only occurred at Colowyo, but
was a regional event as well. The flooding in Craig may have in fact exceeded the 500-year
event! The flooding conditions both at Colowyo and regionally were a result of a very unusual
set of circumstances and were beyond our ability to control.
We would be pleased to discuss this matter with you further if you desire and would be available
to meet with you in your Denver office if this is appropriate.
We look forward to your reply
Sincerely
J mes A.
