r' • 2. The Division of Minerals and Geology ("Division") shall not be a party, but shall participate in the hearing as staff to the Board. II. ISSUES TO BE CONSIDERED Presentations to the Board shall be strictly limited to the issue of whether the pending application complies with the requirements of the Colorado Mined Land Reclamation Act and the regulations promulgated by the Board. Specifically, presentations shall be limited to the question of whether the pending application should be denied or limited on the basis of the following consideration: 1. The necessity of importing topsoil for reclamation to achieve the post mining land use of wildlife habitat. III. WITNESSES AND ERHIBITS No new witnesses or exhibits shall be permitted with the exception of written or verbal comments from the Corps of Engineers, with respect to the need for a 404 Permit, in response to the original notice by the Applicant. This response, or notice of intent to testify, must be received by the Division of Minerals and Geology by September 21, 1993. All documents, exhibits, and photographs presented as evidence at the hearing will become part of the administrative record. IV. PROCEDURE The Division, Applicant and Objector shall make their presentations in the following order. The time limits set out below are maximum limits and shall be strictly enforced. The Board, in its discretion, may allow additional time when warranted. The Board has the right to limit any redundant testimony. Unused time may be used in subsequent rebuttal or closing statements as applicable. At the conclusion of each presentation, the other parties will be afforded an opportunity to conduct cross examination of any of the witnesses that testified during the presentation.
