r' <br />• <br />2. The Division of Minerals and Geology ("Division") shall <br />not be a party, but shall participate in the hearing as staff to <br />the Board. <br />II. ISSUES TO BE CONSIDERED <br />Presentations to the Board shall be strictly limited to the <br />issue of whether the pending application complies with the <br />requirements of the Colorado Mined Land Reclamation Act and the <br />regulations promulgated by the Board. Specifically, presentations <br />shall be limited to the question of whether the pending application <br />should be denied or limited on the basis of the following <br />consideration: <br />1. The necessity of importing topsoil for reclamation to <br />achieve the post mining land use of wildlife habitat. <br />III. WITNESSES AND ERHIBITS <br />No new witnesses or exhibits shall be permitted with the exception <br />of written or verbal comments from the Corps of Engineers, with <br />respect to the need for a 404 Permit, in response to the original <br />notice by the Applicant. This response, or notice of intent to <br />testify, must be received by the Division of Minerals and Geology <br />by September 21, 1993. All documents, exhibits, and photographs <br />presented as evidence at the hearing will become part of the <br />administrative record. <br />IV. PROCEDURE <br />The Division, Applicant and Objector shall make their presentations <br />in the following order. The time limits set out below are maximum <br />limits and shall be strictly enforced. The Board, in its <br />discretion, may allow additional time when warranted. The Board <br />has the right to limit any redundant testimony. Unused time may be <br />used in subsequent rebuttal or closing statements as applicable. <br />At the conclusion of each presentation, the other parties will be <br />afforded an opportunity to conduct cross examination of any of the <br />witnesses that testified during the presentation. Cross <br />examination shall be limited to 10 minutes per party. <br />Division Introduction. (5 minutes) <br />Applicant Overview Presentation. (10 minutes) <br />
