The city has granted the operator use of the <br />road for the purposes of its mining operation. An agreement <br />pertaining use of the city's property is currently being <br />prepared and will be submitted to you under separate cover. <br />The city was sent notice of the application, as required, by <br />certified mail, return receipt requested. The respective <br />receipts are included with the other receipts attached hereto <br />per response No. 1 above. <br />4. If an asphalt batch plant is located on site, areas where oil, <br />grease, and other petroleum products associated with of the <br />plant are located will be bermed to contain possible spills. <br />These materials can be recycled in the plant and, if spilled, <br />will be picked up and reintroduced directly back into the hot <br />mix plant. If the occasion arises that spilled material cannot <br />be directly recycled in the plant, measures will be taken to <br />collect the product by either commercial absorbents (such as <br />bentonite) and/or straw and appropriately disposed. <br />5. The operator will post a performance warranty of $33,700. <br />6.
