Bos 1046 <br />Lamar, Colorado 81052 <br />~ III IIIIIIIIIIIII III` <br />RH: Incomplete applications submitted by the County for Mining <br />Operations. <br />Dear Mr. Winaor: <br />In reviewing our files, it has come to our attention that your county has submitted <br />applications for mining operations which are still incomplete and have never bean issued <br />a permit. A list of these applications and associated information ie attached. <br />The Mined Lead Reclamation Act of 1976 (34-32-101 et. seq. CRS 1973 as amended) and the <br />rules sad regulations adopted pursuant thereto, require that all sand and gravel <br />operations be issued a mining and reclamation permit for this agency. Upon racaipt <br />of an application it is reviewed for completeness. This review determines whether <br />or not all the aeceaaary components of an application are contained in the application. <br />If an application is deemed complete, we then continue with as adequacy reviau+. <br />If, however, an application la incomplete, we notifiy the operator indicating what <br />items are necessary to malcn the application complete. <br />As you probably know, the Colorado legislature passed HB 1182 during the 1979 easaion. <br />This law amends the Colorado Mined Land Ra~~A+*Ation Act in several ways which directly <br />affect the mining operations conducted by counties. Hnclosad ie a copy of the com- <br />plete amended law with the new provisions of RB 1182 incorporated. <br />THS MAJOH PROVISIONS OF HR 1182 <br />1. Counties may submit one compoai~.application and annual report for all <br />similarly eituatnd sand, gravel or quarry operations. <br />2. No application or annual fee will be required of couatiea. <br />Applicabin to reAUlar (more than 10 acraa) operations (34-32-112) <br />1. No application renewal or amendment fee is required of counties. <br />
