This new
mining area will extract coal from the B and C coal seams.
Stipulation No. 12
The approval of Permit Revision No. Two (PR-02) is contingent upon Bureau
of Land Management approval of Coal Lease COC-53510 and Office of Surface
Mining approval of the mine plan for Sanborn East Tract.
Note: Stipulations 1 through 11 were all previously complied with.
The application was submitted by Somerset Mining Company for the Somerset Mine
Sanborn Creek East Tract. This decision is based on a finding that the
operation will comply with all requirements of the Colorado State Program as
found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et
seq., and the Regulations promulgated pursuant to the Act. If no request for
a formal hearing is made within thirty (30) days of the first publication of
the issuance of this proposed decision, then this decision becomes final.
Upon submittal of acceptable surety by the applicant, the permit revision will
be effective. The permit revision application, all supporting documentation
and any stipulations or conditions will become a binding part of the permit.
•
-2-
