D1VIG;~Bulletin` -- November_6 :1`99:8:: ~ ~ ~~ <br />Colorado Mined Land Reclamation Board Hearing Process: <br />Tvgically, any application fora 112 Rewlaz Operation permit or an amendmen[ to a 112 Regular Operation permit <br />requires a hearing before the Mined Land Reclamation Board when there R a wrinen objection. However, prior to the <br />Formal Board Hearing, several other hearings must occur prior to the Forma! Board Hearing. <br />The Informal Conference: <br />The first of the three hearings in the process is the Lzformal Conference. If there are objectiotts--or at the request of the <br />applicant or local board of county commissioners ~- the Division will schedule an informal conference among the <br />parties. The Informal Conference is held after the close of the required comment period, which is about 50 to 60 days <br />from the date an application is considered filed with the Division. <br />The purposes of the informal conference are to: <br />• Explain the three heating process to the parties <br />• Idrntify the issues <br />• Identify the patties <br />• 'Determine what issues have been resolved <br />• Determine if any parties want to withdraw <br />The Per-hearing Conference: <br />The second hearing is the Pre-hearing Conference. It can Decree no sooner than to r days after the Division has made its <br />recommendation to approve or drny the application for a permit or amendmrnt Howevtt, it mutt also occur at least <br />5ve (5) days prior to the Formal Board Hearing. The Pre-hearing Conference is usually conducted by a member of the <br />Mined Land Reclamation Boazd_ The Division is required to mail its recommendation to all parties prior w the Pre- <br />hearing Confezmte. <br />The purposes of the Pro-heating Conferrnte arc to: <br />• Recotnmrnd the issues the full Board should consider <br />• Determine the lists of wimesses and exhibiu to be presented by the partu az the Formal Public Hearing <br />• Determine the amount of time each party will have to make thew presrntations at the Formal Public <br />Hearing <br />• " Prepare a Draft Board Order that will be used to condutt the Formal Board Hearing <br />The Formal Board Hearing: <br />The Formal Board Hearing must be held prior to the automatic approval date for the permit application or the <br />amendment At the Formal Board Hearing, the fast order of business is for the Board to adopt the Drafr Board Order. <br />Parties may objett to the Draft Board Order and seek revisions. Once the Draft Board Order is adopted, the Formal <br />Board Hearing begins. <br />On occasion, as operator may have a consultant represent the operator or company. In order to represent the applicant <br />or operator, the Board and the Attorney General's Office have requested thaz consultants complete a notarized form of <br />designation.
