Long <br />and D Trucking Division Director <br />62477 Jade Road <br />Montrose, Colorado 81401 ~~70~,/ <br />~t'1 <br />RE: File No. IYI-2000-044 and 0-2000-009, Resp4nse_tn~nformation Submitted, by Board <br />Order, Regarding Additional Topsoil Excavation Propos- ed ~ <br />Dear Mr. and Mrs. Goode: <br />The Division received your responses to our Board Ordered inquiry letter dated May 5, 2000 <br />requesting additional information about how you propose to continue excavation of the small reservoir <br />on your property in The Shavano Valley. <br />I[ is the Division's opinion, based on that correspondence, that a Mined Land Reclamation Boazd <br />Permit is needed for any additional excavation and export of material. Our determination is based on <br />the fact that there is no documented proof of a guarantee of site reclamation from other local, state or <br />federal agencies. You may, however, remove any soil material currently stockpiled on site. <br />The Board has requested that the Division make determinations as to the need for a Mined Land <br />Reclamation Board Permit. Please be aware that the Division's determination that a permit is or is not <br />needed, is simply the Division's opinion and can be challenged by any party at a hearing before the <br />Board. If you wish a Board determination, you should request a Declaratory Order heazing-with the <br />Mined Land Reclamation Board by notifying this office. <br />Reffsp2ectfully, <br />H.
