OF MINERALS <br />Reference is made to your letter dated August 10, 1998, <br />regarding an application by Mr. Ed Henne to conduct clay mining <br />from a 280 acre area at the Patton Clay Mine, near Canon City, <br />Fremont County, Colorado, CDMG File No. M-98-067 (Corps of <br />Engineers Action No. 1998 30172). <br />We have studied the project description, other records, and <br />documents available to us. The project is not regulated under <br />the provisions of Section 404 of the Clean Water Act and a <br />Department of the Army permit will not be required.
