Cottony <br />Acting Division DlreClOr <br />The Division of Minerals and Geology (DMG) has reviewed the 2"d and 3rd quarter 2002 <br />Sediment Pond Inspections for the Lorencito Canyon mine. Additional ponds were <br />added over the period as mine operations expanded. <br />All reports were found as required. Addition of flumes and trash racks, as well as <br />seeding operations, were noted in the reports as appropriate for each pond. The <br />photographs included are an excellent addition and well document the ponds as they <br />are built. Regarding the report section "Sediment Storage Capacity" please ensure that <br />each report includes an estimate of the available sediment storage capacity rather than <br />only a notation whether the design capacity has been surpassed. Please refer to Rule <br />4.05.9 15(d). Sediment should be cleaned from the ponds well in advance of exceeding <br />the storage capacity. Furthermore, any exceedance of the design storage capacity may <br />result in an enforcement action. Failure to maintain adequate sediment storage capacity <br />may also result in a denial of any request for application of alternate limitations under <br />the CDPS permit regulating storm water discharge. <br />We have no further questions at this time.
