<br /> <br />EXHIBIT B <br />Mining Plan <br />Although the Division of Highways has designated this pit as being used <br />for maintenance purposes, there may be times when it will be necessary <br />to use it as a source of material for local construction jobs. <br />Specific mining methods will be left to the discretion of the operators. <br />All operations will be restricted to the boundaries of the affected area <br />and the designated haul road. <br />The affected area covers less than 7 acres and the mining area 3.7 acres. <br />No more than 70,000 tons of material will be mined from this pit in any <br />one calendar year. <br />Mining will take place over a period of several years, and it is expected <br />that sand washed in, during periods of high runoff, will continually re- <br />plenish the excavation for as long as the source is needed. <br />• The pit is located within the channel of the south fork of the Arikaree ~ <br />River; an intermittent stream. The pit contains a thick section of fine <br />to coarse gravel sand and gravel overlying hard Pierre Shale bedrock. <br />Mining will be conducted in such a manner as to maintain the stream channel <br />in its present configuration while leaving no new backslopes steeper than <br />2:1. <br />No surface or subsurface water rights will be affected by mining in this <br />pit. <br />The pit site is relatively flat with stream drainage to the northeast. <br />The owner reserves the right to sell mining materials to others than the <br />Division of Highways during the life of the permit. <br /> <br />
