Box 758 <br />Golden, CO 80401 <br />Dear Richard: <br />Coordinator <br />ENGINEERING, INC. <br />rr~ SO~,r~ <br />~,~ <br />In reference to your inquiry of obtaining planning <br />approval from Las Animas County regarding Trinidad Basin <br />Mine, Application ~~77-004 by Mr. Sam Martin on behalf of <br />Alvin Wiggins d/b/a Delagua Coal Company for a Special <br />Use Permit for the establishment and operation of surface <br />and underground coal mining, which was approved on 11 MAY 77 <br />still serves as land use authorization. Enclosed herewith <br />is a copy of Application ~k77-004. <br />Of course, since 1977 many operational and procedural <br />regulations have been changed or amended. However, the <br />zone for the property as described by the permit remains <br />constant as long as the mining operation itself was not <br />officially closed or interrupted. In the event that the <br />operation was terminated, another Special Use Permit must <br />be issued in accordance with The Las Animas County Zo" Wing <br />Resolution. <br />Consequently because the Delagua operation continued, <br />regardless of numerous ownership changes, the permit <br />remained valid. As documented by the enclosed location maps, <br />TBM's amended mining plan is confined to the original <br />legal description as per Application ~~77-004, Hence, land <br />use regulation has already been exercised for the amended <br />mining plan. <br />Regarding cultural and historical resources information, <br />Las Animas County does not require inspection or clearance <br />from any historical society or agency as part of the <br />SAMUEL J.
