!JHER~IS, on November 25 19$0 , the :Tined Land Reclamation Board accepted
suret;~ submitted by SAGUACHE COUNTY and such dace shall be considered the
- data of issuance of the permit and the anniversary date for all ocher purposes; and
'.J'rlEREAS, the `Lined Land Reclamation 3oard has made a finding, fo: the purposes
of issuing this Hermit, that:
1) the application complies with the requirements of the Colorado
:"_ined Land Reclamation pct and al'_ applicable local, state a:td
Federal laws; and,
Z) the operation wi.l1 Hoc adversely affect the stability of any
significant, valuable, and permanent man-made structures located
within too hundred feet of the affected land, e:tcepc where there
is an agreement becaeen the operator and the persons having an
interest in the structure that damage co the structure is to be
compensated for by the operator; and,
3) the proposed mining operations and reclatation can be carried out
in conformance with the requirements of C.R.S. 1473, 34-32-116, as
amended (19'6 Sess. Laws H. 9. 1063); and

open mining operations procedures reasonably desizned to minimize
as much as practicable the disruption from the open minicg operations
and will provide far the rehabilitation of the affected land through t;.ie rehabilitation
of p'_ant cover, soil stability, water resources, and other measures ap.:ropriaca to the
subsequent beneficial use of such wined and reclaimed Lands; and that La the event
of the failure of his proposed reclamation plan, he will take ~:hatzver measures ~:hich
nay be necessary in order co assure toe success of reclamation of the .lands affected
by his open mining operations; and,

ann_roved Sv the `Lined Lard Reclamation Board of the State of Colorado ::s attached
to this permit and thereby becomes a part of the terms hereof.

Land Reclamation act, article 32 of Title 34, C.R.S. 1973, as amended, (1916
